  1. Where do I find a CD-ROM’s terms and conditions?

    The terms and conditions for using a CD-ROM are generally printed on either the packaging or a pamphlet accompanying the CD-ROM. They may also be presented electronically during the software installation procedure. Generally, by installing the software, the user accepts the terms and conditions of use.

  2. Can we reproduce material from a CD-ROM to use in a teaching resource?

    Yes. You can copy images and text within the limits of the Statutory Text and Artistic Licence. If you want to copy more material than is permitted under the Statutory Text and Artistic Licence, you must obtain permission from the copyright owner of the material. See 4: How to Clear Rights for further information on obtaining permission from the copyright owner.

    You should always check whether the CD-Rom is protected by an Access Control Technological Protection Measure. See information sheet, "Copyright Protection Measures and the Copyright Amendment Act" or contact your local Copyright Manager for further advice.

  3. Can we make a back-up copy of a CD-ROM?

    No. Not unless the CD-ROM only contains computer software or the CD-ROM’s terms and conditions specifically allow it.

  4. Are students allowed to copy material from the CD-ROM onto their own flashdrive?

    Yes. If the student is copying the material for research and study and the use is a fair dealing, or if the CD-ROM’s terms and conditions allow it.

  5. Can a school or TAFE lend a CD-ROM to its students?

    Yes. Unless the terms and conditions on the CD-ROM expressly prohibit it.
