APRA/AMCOS & PPCA Non-Educational Use Music Licenses for TAFEs

This information sheet lists the current relevant licences and rates offered by APRA/AMCOS and PPCA for non-educational use of music by TAFE institutes, in particular corporate areas, fitness centres, hair salons, cafes and restaurants and one-off events such as fashion shows or award ceremonies.

Please note the rates listed below are as at November 2015, so we recommend you visit the website of APRA/AMCOS and PPCA at the time you require the licence in case the licence fee has changed.

Music on Hold  (Annual Licence Fee)

Music on phone system

APRA/AMCOS
Calculated on the basis of the number of external telephone lines at each location:
  1. $151.47 for 1-5 lines (plus $37.87 to copy music)
  2. $239.20 for 6-10 lines (plus $58.80 to copy music)

Sound recordings on phone system

PPCA
Calculated on the basis of the number of external telephone lines at each location: 

  1. $76.34 for 1-2 lines
  2. $153.12 for 3-5 lines
  3. $230.01 for 6-10 lines

Background Music  (Annual Licence Fee)

Music in public areas (areas in which the general public is admitted)


APRA/AMCOS

Calculated on the basis of the size of each area in which music is played, type of device:  

  1. $75.91 for up to 150m² on one device (radio or TV)
  2. $126.51 for up to 150m² on one device (CD  or DVD player, PC, tablet, MP3 player, background music service or digital music service
  3. $202.39 for up to 150m² on two to four devices and/or a multi-channel device of up to four streams and/or a jukebox

Sound recordings played as background music

PPCA

Calculated on the basis of the size of each area in which sound recordings are played:

  1. $76.67 for an area up to 140m² 
  2. $103.33 for an area between 141m² and 465m²
  3. $140.78 for an area between 466m² and 930m²

Music in the Workplace  (Annual Licence Fee)

Music in offices (areas and functions to which the general public is not admitted eg. offices,
staff training sessions, reception areas)


APRA/AMCOS
92c per employee for public performance with minimum fee of $59.75 a year plus 92c per employee for copying music with minimum fee of $61.07 per year for each

One-Off Events  (obtained before an event) 

Perform live music or play recorded music

APRA/AMCOS

Fee varies according to nature of event and fee:

  1. Concerts of live artists where admission fee is charged - 1.815% of gross admission fees subject to minimum fee of $55
  2. Performance of live artists at event where no admission fee - 2.2% of gross expenditure on performers subject to minimum fee of $55
  3. Events where music featured but not primary focus e.g. comedy shows – 1.815% of gross admission fees pro-rated by the music use percentage over the event's duration, subject to minimum fee of $55
  4. One-off dance parties charging entry fee -$3.22 per person admitted - minimum fee of $57.77
  5. Sporting events where live and/or recorded music is performed before, during and after the event - higher of 2.2% of gross expenditure on live artist performers plus $55 per day for recorded music use via devices such as large screen TVs; or 4.4 cents per person admitted to each day of the event, subject to minimum fee of $55
  6. Events where live and recorded music is played and where the ticket price includes food and beverage costs -1.815% of gross admission fees (less deduction capped at 40% of gross catering expenses for food and beverages), subject to a minimum fee of $55
  7. Performances of music included in the soundtrack of the films, and includes background music played for the duration of the film festival, but does not include performances of live artists and DJ's - 0.462% of gross box office receipts, subject to a minimum fee of $64.94
  8. Performances of live artists or recorded music that do not fit any event types described above - Fees range from $55 to $550, subject to music use and size of the event

Sound recordings played at events or festivals

PPCA
Fee varies according to type of event and number of guests:

 

  1. Where sound recordings played at open-air events the higher of $0.1738 per person, per event, per day (based on estimated attendance) or $60.89 minimum fee
  2. where sound recordings are used as featured music entertainment or accompaniments at an event $0.2497 per person, per event , per day (based on the estimated attendance); or $60.28 minimum fee
Note that separate licence fee is payable for each area where protected sound recordings are played.

Sound recordings played at events not covered by specific tariffs eg. dance academy concerts

PPCA
Either $140.78 per annum for all events covered by this tariff or $60.89 for a single event

Restaurants/Cafes  (Annual Licence Fee)

Public performance of music in cafes or restaurants


APRA/AMCOS 

Fee calculated according to type of music use –  

  1. Music on website only - $167.15
  2. Background music in restaurant/café - $278.58
  3. Background music in your restaurant/café + on website - $354.55
  4. Background music + music on website + unlimited annual featured music performances - $911.70

Under option 2 or 3 above, there is a complimentary licence for one night’s performance of live music.

If background music is provided by a background music supplier there may be a reduced background music licence fee (contact APRA for more information).

Sound recordings played in restaurants or cafes

PPCA

Rates apply per person of seating capacity for each day of operation and vary according to average cost of main meal.

  1. Where average cost of main meal less than $7.50 the rate per person is $0.036 with maximum daily rate of $2.16 and subject to quarterly minimum fee of $53.04
  2. Where average cost of main meal under $15.00 the rate per person is $0.072 with maximum daily rate of $4.32 and subject to quarterly minimum fee of $53.04

Hair Salons, Coffee Kiosks/Take-away Food Outlets  
(Annual Licence Fee)


Public performance of music in hair salons, coffee kiosks or take-away food outlets

APRA/AMCOS 

Rates vary depending on number and type of devices.

  1. One device - radio or TV - $75.91
  2. One device including CD or DVD player, PC, tablet or MP3 player, background music service or digital music service - -$126.51
  3. Two to four devices and/or a multi-channel device of up to four streams and/or a jukebox - $202.39
  4. Five or more devices and/or a multi-channel device of five or more streams and/or a jukebox - $379.50

Fitness Centres (Annual Licence Fee)

Playing music in fitness centres

APRA/AMCOS

Fee depends upon number of classes and customers:

Background music $0.85 per member (minimum fee $196.93)

Classes $2.61 per class OR $1.57 per classes for classes with 10 or less people AND $3.66 per class for each class with more than 10 people

Virtual fitness classes - $0.113 per member of your fitness centre with a minimum fee of $56.27

PPCA

Covers playing of sound recordings in a fitness class only. For background music played in fitness centres see tariff V2 below.

  1. Single rate per PPCA class $2.53 or two tiered rate per PPCA class with 10 or fewer participants $1.52 and with more than 10 participants $3.55

Fixed fee per room, level or area where protected music is played:  Background $76.78 per area

Dance Classes (Annual Licence Fee)

Sound recordings played as an aid to tuition during dance classes

PPCA

Calculated on the basis of number of days that classes are offered:

  1. $68.67 for first day of operation per week plus $33.55 for each additional day of operation per week.

Music Videos (Annual Fee)

PPCA 

  1. Where single screen used in a room to display music videos - annual fee of $680.71 for screen size up to 75 cm and $1,362.09 for screen size between 76-250 cm
  2. Where multiple screens used in a room to display music videos - annual fee of $1,021.28 for first two screens and $169.57 for each additional screen for screen size up to 75 cm and $2,043.69 for first two screens and $340.01 for each additional screen for screen size between 76-250 cm
Note a separate licence fee is payable for each room where music videos are displayed.
